So far we know that David has no fear of being brought to trial, has no
phone or address, does not mind stepping on the toes of the companies that
make the products he claims to sell, and that any money you send to him is
genuine.

The problem here is that he can sell you the physical goods quite
legally by using a dubious loophole in the law he claims to fit his
marketing model.

Where it gets nasty is that *YOU* can't load the programs or use them
without breaking the law. So in clear language, he is aiding and
abetting to commission of a crime by providing the software to you in
the first place.

There was a case in Australia where someone took on Microsoft and their
"Educational" license which saw Windows XP Professional (which sold for
over $400 AUD) being sold as an Educational version for a little over
$100AUD and it was the same product, re-labeled.

The outcome was that it is not illegal to sell Educational version
software to anyone who has the money to buy it as opposed to the
previous need to provide evidence of your entitlement to Educationally
priced software.

That didn't change the license conditions for the software. It was and
is still illegal to load it onto a business computer or use it for
business purposes. This is not about the ethics or morals of Adobe and
Microsoft. It is about the laws that our society has to protect all of
us with an original idea from having it abused by those who think the
only time what they do is illegal is when they get convicted.

Like it or not, anyone with enough brains to write and develop a program
like Photoshop, has a legal right to profit from it and that right is
protected in our democratic society. Co-incidentally, it also affords
protection to those like this piece of wasted space who discover a flaw
in the letter of the law and think it OK to exploit it.

What is wrong with all you guys????

It's like you guys have no idea what your rights are AND are willing to
allow these software companies to rip you off !!! This is nothing, do
you realize the amount of piracy that occurs with these products, I
mean at least these guys are soliciting "genuine product" and not
selling fakes or "backup" copies like people on ebay do and getaway
with that (whats up with that??)

First off, let me explains few things to you highly inclined textbook
reading sheep. FIRST SALES DOCTRINE, anyone hear of this?? this is one
of our fundamental rights, once you purchase anything, you are the
proprietor and as the proprietor you have the legal right to do what
you want with it. Imagine this ok, imagine you went out and bought a
pair of Nike running shoes and then suddenly you decided to change the
laces on your shoes, oh nooooo!!!, and then Nike found out and decided
to bring you to court because you did not adhere to their "buy Nike
shoes policy", where you are not allowed to change the image of their
shoes as this would dilute the company's image and subsequently affect
their earnings.. this is lame right, ludacris, unbelievable.. but this
is comparable to our case here and before you say anything, read the
softman vs adobe case and try to understand why it ruled in favor of
softman.

I've been following these threads on this topic since "david" made his
first posting and i did not rip into this guy and you know why??
because I am a consumer and i look for bargains out there just like all
of you do!!! In this case, I informed myself, I read all about this
Adobe case and I have learned something new. You see the only
difference between Nike and Adobe is that Adobe uses these licensing
agreements to change the transaction around, in this case you are
buying the right to use their software, not the actual software itself
BUT the right to use it, this is their way of bouncing around this
fundamental right, but think of it simply, when have you ever bought
something and not have been allowed to do what you want with it?
exactly!!, this is whats going on here, all software companies are
guilty of it and this is the reason it was thrown out of court.

When I see these threads you people are just supporting this kind of
corporate behaviour, you use your fancy jargon, legal talk and witted
responses to come across sooo intelligent but how intelligent are you
to be taken advantage of??? here, let me help you figure this out in
$$$, becuase $$$ always talks right???

Adobe Creative Suite Premium CS2: buy at adobe $1199.00 (WOW huh), i
wonder how many of you actually can aford this right now??

Education version: $800, $400 bucks difference, and btw, i called Adobe
on this, and you should do also, i have every right to use this copy
just as if it were intended for commercial use, I get support, updates,
the whole 9 yards..

You guys can pay the full price or better yet you can download it off
some torrent or just buy the backup copy on ebay, BUT stop posting as
if you know it all, like software companies dont have an agenda, like
the FDA dosen't, like our gov't dosen't, AND don't regurgitate the
law, try to understand it and what is really going on, i mean this guy
has left us with this case, I informed myself before I just posted
anything for the sake of showing off my intellect and my writing
abilities or for that matter my loyalty to the sheppard.

Dear Mike,

Always soo insightful, have you checked your site lately?? have you
seen which companies you are promoting, here you are contributing to
these threads and trying to be righteous and informing us all of what
justice will be served, and then on your site, which we all know what
it is since you never fail to leave it after each posting (vested
interest) is advertising for these other companies which are clearly
doing the samething.

Firstly, those that sin should not cast a stone in a glass house, check
out your site brother !! and please dont act like you dont know whats
going on, you seem like a highly intelligent guy and you know alot
about the law so I shouldn't have to tell you where to look.

hey and if your all such concerned citizens, maybe your should direct
your ADOBE energy and turn it into BUSH energy..

Well of course they are fantastic people. They have nothing to do all
day but wait on the next unemployment cheque and check the state of
their latest brew!

I know this for a fact. One of my print centers is next door but one
from a home brew shop.
