Author Missing Layer from MX to MX 2004

I was perplexed to see that a page I had created happily in MX with "nested"
layers would not appear the same within MX 2004's Layer Panel. The "highest"
(z) layer (default visible) would not appear in the panel. Two sub-layers
which had been underneath the top layer are shown as not nested. And yet I can
click on the layers in the Design area. When I click and delete the top layer
(not shown in panel) it deltes the two which were nested in MX but not showing
as nested in 2004 panel.

Why would the same file open and edit OK in MX and not in MX 2004?

TIA

Mal
